Supreme Court Outlines New Test for Determining When Clean Water Act Permits Required
May 15, 2020The U.S. Supreme Court in the case of County of Maui v. Hawaii Wildlife Fund recently held that discharges originating from a point source which are either directly discharged into surface waters regulated by the Clean Water Act (CWA), or are the “functional equivalent” of such direct discharges, are subject to National Pollutant Discharge Elimination System (NPDES) permitting requirements. The decision lists several factors relevant to determining whether discharges indirectly reaching regulated “navigable waters” through groundwater or other diffuse media require CWA permits, including time and distance traveled. -
