Clean Energy Rule to Replace Clean Power Plan
(August 28, 2018) – EPA released a pre-publication version of its Affordable Clean Energy (ACE) rule, which would replace the 2015 Clean Power Plan (CPP). The goal of the CPP was to reduce carbon dioxide emissions for electrical power generation, but it is facing legal challenges by a coalition of 27 states that argue the Plan exceeds EPA’s authority under the Clean Air Act.
The ACE modifies the emission reduction goals of the CPP and provides more flexibility to states in developing their plans to respond to the emission guidelines. NACWA is currently reviewing the ACE to determine its potential impacts on clean water utilities.
NACWA previously submitted comments to EPA on the proposed CPP model trading plans, supporting the proposal’s recognition that biomass-derived fuels can be an important part of reducing carbon dioxide emissions. NACWA will continue support the use of biogas and biosolids as a renewable energy source and will advocate for inclusion of these energy sources in any trading plans that are developed.
